These Terms & Conditions (the “Terms”) govern the use of the Chef Lab Store website and the purchase of products from our online store. By using our website or placing an order, you agree to be bound by these Terms.

Nothing in these Terms is intended to limit your statutory rights as a consumer under applicable EU and Polish law.


1. Definitions

For the purposes of these Terms:

  • “Store” – the Chef Lab Store online shop operated at cheflabstore.com.

  • “Seller”, “we”, “us”, “our” – PROF-STORE Sp. z o.o., details as specified above.

  • “Customer”, “you”, “your” – any natural person (consumer) or business who uses the Store or places an order.

  • “Consumer” – a natural person acting for purposes which are outside their trade, business, craft or profession, as defined by EU and Polish law.

  • “Business customer” – any customer who is not a consumer.

Where these Terms make no distinction, they apply to both Consumers and business customers. Where a clause is intended only for Consumers, this will be clearly indicated.


2. Scope and acceptance of the Terms

  1. These Terms apply to:

    • the use of the Store,

    • the conclusion and performance of sales contracts for products offered via the Store.

  2. By accessing the Store, browsing it, creating an account, or placing an order, you confirm that you have read and accepted these Terms.

  3. If you do not agree with these Terms, you should not use the Store or place orders.


3. Use of the Store and customer account

  1. To use the Store, you need:

    • internet access,

    • a compatible device with a web browser,

    • an active e-mail address.

  2. You may browse the Store without creating an account. Some functionalities (e.g. order history, saved addresses) may require registration.

  3. When creating an account, you must provide accurate, complete and up-to-date information and keep your login details confidential. You are responsible for all activities that occur under your account.

  4. We reserve the right to temporarily suspend or permanently disable an account or refuse an order if:

    • you violate these Terms or applicable law,

    • you provide false or misleading information,

    • your behaviour causes or may cause damage to us, other customers or third parties.


4. Product information

  1. We make every effort to ensure that product descriptions, photos and other information are accurate and up-to-date. However, minor differences in colour, finish or packaging may occur due to screen settings or manufacturing changes.

  2. All prices shown in the Store:

    • are given in the currency indicated on the website (e.g. EUR, PLN, etc.),

    • include applicable VAT for deliveries within the EU,

    • do not include shipping costs, customs duties or import taxes for non-EU countries (these are displayed or explained separately).


5. Ordering process and conclusion of the contract

  1. Products displayed in the Store constitute an invitation to treat, not a binding offer.

  2. To place an order, you must:

    • add chosen products to the cart,

    • proceed to checkout,

    • provide required details (billing, shipping and contact data),

    • select a shipping method,

    • choose a payment method and complete payment.

  3. After placing the order, you will receive an order confirmation email. This confirmation means that we have received your order but does not yet guarantee acceptance.

  4. The sales contract is concluded when:

    • we accept your order and start processing it (for example by sending a separate confirmation or dispatching the product), or

    • in some jurisdictions, at the moment you receive an electronic confirmation on a durable medium (such as PDF attached to the order confirmation email) – we aim to comply with applicable EU rules in this respect.

  5. We may decline or cancel an order in particular if:

    • the product is unavailable,

    • there is a clear pricing or description error,

    • we are unable to verify payment,

    • the order appears fraudulent or made in bad faith. In such cases, any payments already made will be refunded.


6. Prices, payments and currency

  1. The total amount payable for your order includes:

    • product price(s),

    • shipping costs, and, where applicable,

    • any other charges clearly indicated at checkout.

  2. Accepted payment methods are shown at checkout (e.g. credit/debit cards, online payment services, etc.).

  3. All payments are processed via secure payment providers. We do not store full card details on our servers.

  4. For orders delivered outside the EU, your bank or payment provider may apply additional fees or currency conversion charges; we are not responsible for such costs.


7. Delivery

  1. We ship orders from Poland (EU) to:

    • addresses within Poland,

    • most EU member states,

    • selected non-EU countries, including the United States, as indicated on our Shipping Policy and at checkout.

  2. Delivery options, estimated delivery times and costs are described in detail in our Shipping Policy, which forms an integral part of these Terms.

  3. Risk of loss or damage to the products passes to you when the products are delivered to the address provided in your order, or when you collect them from the carrier / parcel locker, in line with applicable law.

8. Right of withdrawal and returns (Consumers in the EU)

  1. If you are a consumer residing in the European Union, you have a statutory right to withdraw from a distance contract within 14 days without giving any reason, subject to legal exceptions.

  2. The conditions, procedure and consequences of exercising your right of withdrawal, as well as rules for returns and refunds (including for defective products), are explained in detail in our Refund & Returns Policy, which forms part of these Terms.

  3. Where the Terms and the Refund & Returns Policy differ, mandatory consumer protection rules of your jurisdiction will prevail.


9. Complaints about non-conforming goods

  1. We are obliged to deliver products that are in conformity with the contract, in accordance with applicable EU and Polish consumer rights legislation.

  2. If a product you receive is:

    • defective,

    • damaged,

    • or otherwise non-conforming,
      you should notify us as soon as possible and follow the complaint procedure described in our Refund & Returns Policy.

  3. If non-conformity is confirmed, you may be entitled to:

    • repair or replacement,

    • price reduction, or

    • termination of the contract and refund,
      according to applicable consumer law and our Refund & Returns Policy.


10. Customer obligations and acceptable use

By using the Store, you agree that you will:

  1. Use the Store in accordance with the law, these Terms and good practice, respecting the rights of other users and third parties.

  2. Not engage in activities that could:

    • disrupt the operation of the Store,

    • compromise security,

    • overload our infrastructure,

    • or involve attempts at unauthorised access to data or systems.

  3. Provide accurate and truthful information when placing orders or creating an account.

  4. Not use the Store to distribute unlawful content, spam, or malicious software.

We reserve the right to take appropriate measures (including blocking access, cancelling orders, or informing relevant authorities) if we reasonably suspect abuse or illegal activity.


11. Intellectual property

  1. All content in the Store, including text, graphics, logos, photos, product descriptions, layout, and other materials, is protected by intellectual property rights and either belongs to us or is used with appropriate licences.

  2. You may use the Store and its content only for personal, non-commercial purposes, to browse products and place orders.

  3. You may not:

    • copy, reproduce, modify, distribute or publicly display Store content without our prior written consent,

    • use our trademarks, logos or brand elements in a way that could mislead or suggest an association without permission.


12. Personal data and cookies

  1. The processing of your personal data in connection with the use of the Store and placing orders is governed by our Privacy Policy, which explains:

    • what data we collect,

    • how and why we use it,

    • how it is protected,

    • and what rights you have under GDPR and other applicable data protection laws.

  2. Information about cookies and similar technologies used in the Store is described in our Cookie Policy (or in a dedicated section of the Privacy Policy, depending on how you structure it in Shopify).

By using the Store, you acknowledge that you have read our Privacy Policy and Cookie information.


13. Limitation of liability

  1. We are not liable for:

    • minor differences between product photos and the actual product arising from display settings or manufacturing tolerances,

    • delays or failures in performance caused by events beyond our reasonable control (force majeure), such as natural disasters, strikes, major disruptions in transport or energy supply, or serious network failures.

  2. Nothing in these Terms limits or excludes our liability where such limitation or exclusion would be unlawful under applicable law, in particular in respect of:

    • death or personal injury caused by our negligence,

    • fraud or fraudulent misrepresentation,

    • statutory rights of consumers that cannot be waived or limited.


14. Changes to the Terms

  1. We may update these Terms from time to time, for example due to:

    • changes in the law,

    • changes in the Store’s functionality or our business processes,

    • new products or services.

  2. The updated Terms will be published on our website with the date of the last update.

  3. The version of the Terms in force at the time of your order applies to that order, unless a change is required by law and must apply retroactively.

For compliance with certain EU rules, we may also provide the Terms in a durable medium (e.g. PDF) attached to your order confirmation email.


15. Governing law and dispute resolution

  1. These Terms and any contracts concluded via the Store are governed by Polish law, subject to any mandatory consumer protection provisions of the country where you habitually reside (if you are an EU consumer).

  2. Any disputes arising from or in connection with the use of the Store or these Terms will be:

    • in the first instance, resolved amicably by contacting us at profstore.pl@gmail.com,

    • if no agreement is reached, submitted to the competent courts under applicable jurisdiction rules.

  3. If you are an EU consumer, you may also use out-of-court complaint and redress mechanisms, including the EU’s Online Dispute Resolution (ODR) platform, where available in your country.
